1. Eligibility

You must be at least 13 years of age to use the Service. By creating an account, you represent and warrant that you are 13 years of age or older. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Acceptance of Terms

By creating an account and using Fit For Wealth ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

3. Medical Disclaimer

Fit For Wealth provides fitness tracking tools and AI-generated workout programs for informational purposes only. The Service is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified physician or licensed fitness professional before beginning any exercise program, especially if you have a pre-existing medical condition, injury, or health concern.

4. Assumption of Risk

Exercise involves inherent risks including, but not limited to, muscle strain, joint injury, and cardiovascular events. By using the Service, you voluntarily assume all risks associated with physical exercise and fitness activities. You represent that you are physically capable of participating in exercise programs.

5. AI-Generated Content

Workout programs on this platform are initially drafted with the assistance of artificial intelligence based on information you provide, and may be reviewed, edited, or approved by a human coach before being made available to you. These programs — whether AI-assisted or coach-edited — are suggestions only and are not guaranteed to be appropriate, safe, or effective for your specific circumstances. Fit For Wealth makes no warranty that program content is error-free or medically sound.

6. Subscription & Billing

Certain features of the Service require a paid subscription. Subscriptions are billed on a recurring basis through our payment processor, Stripe. Your free trial (if applicable) will automatically convert to a paid subscription at the end of the trial period unless you cancel. No refunds are provided after a billing period has begun. You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing period.

7. Data & Privacy

We collect personal information including your name, email address, and health/fitness data you voluntarily provide. This data is used solely to provide and improve the Service. We do not sell your personal data to third parties. Data is stored securely using industry-standard practices. For full details, see our Privacy Policy. By using the Service, you consent to this data collection and use.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Fit For Wealth, its owners, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to physical injury, property damage, or loss of data. Your sole remedy for dissatisfaction with the Service is to stop using it.

9. Indemnification

You agree to indemnify and hold harmless Fit For Wealth and its affiliates from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

10. Dispute Resolution & Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

Class Action Waiver: YOU AND FIT FOR WEALTH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.

This arbitration agreement does not apply to claims for injunctive or other equitable relief, or to claims that can be brought in small claims court. Either party may seek emergency equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date above. Continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. To the extent court proceedings are permitted under these Terms, the parties consent to exclusive jurisdiction in the courts of Illinois.
